General Terms and Conditions of Sale

This document governs the terms and general conditions of sale (hereinafter, the “General Conditions”) that apply to purchase orders for our products (hereinafter, the “Products”) placed by you through the website https://lumon-brand.com (hereinafter, the “Site”).

We invite you to carefully read these General Conditions before proceeding with the purchase order for the Products (hereinafter, the “Order”).

Together with our privacy policy, cookie policy, Site terms of use, and the Order Confirmation as defined below, these General Conditions govern the entire contractual relationship between you and Lucia Monterosso, owner of the sole proprietorship with legal name LUCIA MONTEROSSO, registered with the Alessandria Chamber of Commerce – REA Number: AL-318344, with registered office at Spalto Borgoglio 93, 15121 Alessandria (AL), VAT number 02786270062 (hereinafter, “Lumon”).

To accept these General Conditions, you must select the “I accept the terms and conditions” box at checkout. If you do not accept, it will not be possible to complete the Order.

Lumon invites you to download and keep a copy of these General Conditions.

Article 1 - Purchase Orders and Formation of the Contract

Sending the Order constitutes a purchase proposal addressed to Lumon. The confirmation of receipt of the Order does not constitute acceptance.

The contract is considered concluded only when you receive the Order Confirmation, sent by e-mail.

The availability of Products on the Site is not guaranteed and may change without notice. In case of unavailability of the ordered Product, customer service will promptly inform you and you may choose to replace the Product or cancel the Order.

Article 2 - Prices and Payments

All prices are expressed in euros and include VAT.
Shipping costs are added to the total price of the Products:
- €4.99 for each shipment within Italy;
- free for orders over €100.00.
Lumon reserves the right to change prices at any time, without notice.
Accepted payment methods are: PayPal

Article 3 - Delivery

Products are shipped to the address indicated in the Order and confirmed in the Order Confirmation.
Orders are usually processed within seven (7) working days from the Order Confirmation.
Delivery is usually made within five (5) working days from shipment.
Pursuant to art. 63 of the Consumer Code, the risk of loss or damage to the goods passes to the consumer only at the time of delivery, unless a carrier not proposed by Lumon has been chosen.

Article 4 - Defective Products and Warranty

In case of conformity defects, the customer has the right to repair or replacement, or – in cases provided by law – to a price reduction or contract termination.
The legal conformity warranty is valid for two (2) years from delivery for consumers and one (1) year for professional customers.
Damages resulting from improper use, negligence, or unauthorized modifications of the Product are excluded from the warranty.

Article 5 - Right of Withdrawal and Returns

Pursuant to articles 52 et seq. of the Consumer Code, if you are a consumer you have the right to withdraw from the contract within fourteen (14) calendar days from delivery of the Products, without having to provide any reasons.
To exercise the right of withdrawal, you can send a communication to lumon.brand@gmail.com.
The Product must be returned intact, in its original packaging, within fourteen (14) days from the communication of withdrawal.
Return shipping costs are borne by the customer, unless otherwise indicated.
Lumon will refund the amount paid (including the initial standard shipping costs) within fourteen (14) days from receipt of the returned goods.

Exceptions: the right of withdrawal does not apply to customized Products or sealed Products that are not suitable for return for hygiene reasons once opened.

Article 6 - Limitations of Liability

Lumon is not liable for disruptions due to force majeure (strikes, weather events, network problems, interruptions of third-party services).

In no event shall Lumon be liable for indirect or unforeseeable damages. However, the consumer's non-waivable rights remain unaffected.

Article 7 - Intellectual Property

Trademarks, logos, texts, images, and content on the Site are the property of Lumon or their respective owners. Use is not permitted without written authorization.

Article 8 - Applicable Law and Jurisdiction

These General Conditions are governed by Italian law.
For consumers, the court of the place of residence or domicile has jurisdiction.
For professional customers, exclusive jurisdiction is with the court of Alessandria.

Article 9 - Further Information

Lumon reserves the right to modify these General Conditions without notice.
